When it came time for ZBA the height of the tower was increased to 44 floors, however Vive was ignoring a mezzanine level which the city considered a floor which increased the floor count to 45 but didn't change the measured height.

Floor counts are expected to be similar to the Growing Together plan, but not identical.
So they're building the 45 story tower only and that is the one that's going up now? Thanks.

Right now the building that is under construction is only the 45 floor tower, there will be future phases of the development but they do not have approvals from the city yet.
