The "owner" is the condo corporation, which is bound by the Condo Act to provide sufficient funding for the reserve fund to support future repairs and maintenance--and those funds will come from the condo fees. So, regardless of who lives in the units, the reserve fund will be there.
And "Kitchener" did not work on this building, IN8 did. Even if there had been architectural oversight, no one could have prevented the developer from installing poor-quality materials.
